Tenants sue Mango Square management…

10 Mango Square tenants file a civil suit against the mall management with hopes of a premilinary injunction to restore power and water supply. Due to panic, Mango square mall in Cebu city cut off electric power and water supply of their tenants.

The plaintiffs are are Ruth Adizas (Daj Bar); Flordeliz Alfeche (Pinoy Corner); Jericho Custodio (Chill Ville); Alita Jordan (Jaruk); Joel Lee (Booze and Burp); Jovelan Mayol (Kawki’s Kiosk); Gerard Pañares (Barrio Loco); Luisito Sarsaba (Beach Roots); Theodore Villarimo (Marthe’s Place) and Vince Yap (Cravingz). The tenants also asked for damages worth PHP2million and an additional of PHP70,000 for lawyer’s fee and cost of suit.

Aside from the complaint, the tenants also asked for damages amounting P2 million and additional P70,000 for lawyer’s fees and cost of suit.

They file a civil suit against Ludo Luym Development Corp. owner of the complex; members of the board and directors of Ludo Luym; and Conrad Steven Ding, former operations manager of Mango Square. Some of the contracts of the tenants are set to expire within a year while the other lease has until 2008. According to the tenant they paid at least PHP150,000 for the installations and construction of their kiosk. And now the owners have introduced new provisions in the lessor-lesse contract.

Tenants said that they where forced to sign the lease contract the same day they were sent. They said that a month ago more tenants leased spaces outside the mall, which caused problems in sanitation, security, peace and order, and traffic.

According to their ATTY. Francisco Amit Jr. they wanted to seek a 10 million pesos in damages but they could not raise the filling fee of PHP500,000 so they settle for PHP2 million.

The tenants are still willing to settle this with management.

At the Cebu City Hall, the city Administrator Francisco Fernandez will conduct an investigation on possible lapses on some of the city government offices because some owners of the illegal structures at Mango Square were issued business permits.

The mall has only six more days to remove the illegaly constructed structures on the parking lots and sidewalks of Mango Square mall.Mayor Tomas Osmena said he is willing to extend the deadline he gave the mall as soon as he sees the management taking action to correct their violations.

For the tenants they stood firm citing that the current contact has not yet expired. Since they were forced stopped their business, this constitutes a breach in the contract and they ask a php100,000 each for loss of income and another 100,000 for moral and exemplary damages. They also ask the court to order the defendants to restore power and water supply.

    As of 6/28/2010 Conrad Steven Ding and Frederick Ding are charged with estafa (swindling), syndicated estafa, and passing worthless checks. Both are collaborating as a father-son team and are crooks of the highest order.
    One should not do business with any “Ding” or “Salas-Ding” under any circumstance. To do so is to throw away any money invested or hope of return.
